The Energy Community Regulatory Board (ECRB) has been established by the Energy Community Treaty (article 58), as an Institution comprising representatives from the Energy Regulatory Authorities of each Contracting Party and from the European Community. Representatives from the European Regulators Group for Electricity and Gas (ERGEG), from regulatory Authorities of European Community Member States (Participants), and Observers may also take part in the ECRB activities in accordance with articles 59, 95, 96 of the Treaty.
ECRB functions comprise, according to the Treaty and the ECRB Internal Rules of Procedure:
Advising the Ministerial Council (MC), the Permanent High Level Group (PHLG) and the European Commission on statutory, technical and regulatory rules, in particular with regard to monitoring and assessing the operation of the regional energy networks and network energy market;
Issuing recommendations to the Parties when so entrusted by the Treaty, and on cross-border disputes involving regulators upon request of any of them;
Taking measures under Title II (The extension of the acquis communautaire), III (Mechanism for operation of Network Energy markets) or IV (The Creation of a Single Energy Market) of the Treaty, if so empowered by the Ministerial Council;
Facilitating consultation, co-operation and co-ordination amongst regulatory Authorities to a consistent application of the acquis communautaire;
Making recommendations and preparing reports with respect to the functioning of the energy markets;
Issuing requests in case of failure by a party to comply with a Treaty obligation (according to articles 90 and 92 );
Adopting Procedural Acts on regulation of internal organizational issues.
ECRB meets four times a year in Athens which is the seat of the Board. The constituent meeting was held on December 11, 2006. The current ECRB President is Mr. Mirsad Salkić (Chairman of the State Electricity Regulatory Commission of Bosnia and Herzegovina). The European Commission acts as Vice-President in accordance with Article 61 of the Treaty.
